Embakasi East MP Babu Owino was today released on a Sh200,000 cash bail after being charged with causing a voter grievous harm.
The legislator was given an alternative Sh500,000 bond in the case which included the charge of using force during the August 8 general election.
He was re-arrested on Wednesday moments after being released on Sh500,000 and two Sh1 million sureties over an incitement to violence charge.
Babu was earlier charged with subversion, insulting President Uhuru Kenyatta and incitement to violence.
These arose from his apparent reference to Uhuru as ‘mtoto wa mbwa’, remarks he said he will not apologise for as referring to someone as a “puppy” is not abusive.
Police said the legislator was re-arrested for inciting the public to violence on his Facebook page.
Chief magistrate Joyce Gandani granted Babu’s release saying the prosecution did not give compelling reasons for detaining the MP.
“It is not contended that the accused is an MP and can therefore be easily traced. In previous cases the accused has not been convicted,” Gandani said in her ruling.
“Claims that the accused is being harassed cannot be ignored.”
Gandani further said unnecessary denial of bond will create chaos since the prosecution did not give compelling reasons for bail not to be granted.
