According to a letter seen by Kenya Today, Governor Kidero is yet faced with a potential legal suit after Law Society of Kenya CEO Apollo Mboya threatened to take legal action following slanderous comments Dr. Kidero made about Mr. Mboya’s decision to forgive political scientist Mutahi Ngunyi.
A video doing rounds on social media shows Dr. Kidero addressing a crowd in Homa Bay and refers to Mr. Mboya as ‘a stupid boy’.
Mr. Mboya sued political scientist Mutahi Ngunyi for ethnic contempt against himself as a person and as a member of the Luo community. Days later, Mutahi Ngunyi apologized, offering a goat as a sign of regret.
Mr. Mboya indicated he had forgiven him, sparking protests from several quarters that he shouldn’t have shown mercy.
While addressing a public gathering in Homa Bay, Nairobi Governor Dr. Evans Kidero joined the bandwagon of the those castigating Mr. Mboya, and referred to him as a ‘stupid boy’.
However, Mboya has not taken the comments lightly and has called on the governor to publicly apologize to him or face legal action. Below is the letter he has written to the Governor.
I am seized of a video circulating in the social media in which you make slanderous, disparaging and highly defamatory statement on my person; to wit that I am â€œa stupid boyâ€. That particulars of the video are well within your knowledge.
The said statement which was made on Saturday 12th September 2015 or thereaboutsÂ in a public forum has not only caused me mental anguish but has lowered my esteemÂ among my family members, friends, professional colleagues and the public in generalÂ since it portrays me as airhead, blockhead ,dimwit, dope, dork, dumbbell, dunce, fool,Â idiot, imbecile, lamebrain, lunkhead, meathead, nitwit and simpleton.
According to you, I am â€œa stupid boyâ€ because I forgave Prof Mutahi Ngunyi for the unfortunate utterances directed at me and to your community. You may recall that notÂ long ago, you slapped Hon. Rachel Shebesh in full view of the camera and the public and she was magnanimous enough to forgive you. I assure you that Hon Shebesh is not stupid.
Further, vide the Kenya Gazette Notice Vol. CXV â€“ No. 147 of 11th October 2013 you also appointed this â€œstupid boyâ€ a member of your Taskforce to Audit and Examine the Delivery of Legal Services to Nairobi City County Government. I do not consider you stupid for having appointed me.
By another separate letter, I will address you on the findings of the Taskforce and the financial cover up that this â€œstupid boyâ€ together with other Taskforce members unearthed on your door steps.
Your behavior is not only unbecoming of a public officer but demeans the office you are holding as the Governor of Nairobi County and does not inspire confidence in your ability to not only unite Kenyans but also to serve the public.
I am offering an early opportunity to you to apologise for your utterances within three (3) days, failure to which be rest assured that I will commence the necessary legal steps to not only recover my entitlements for the reputational injury and stop similar utterances you but also to cite you for bringing the office of the Governor into disreputeÂ contrary to the Leadership and Integrity as provided in Chapter Six of the Constitution of Kenya.
