The high court in Nairobi has ordered the government to respond to issues raised by CORD in an urgent application today challenging the constitutionality of the recently passed security law.
Judge Isaac Lenaola however declined to suspend the bill as CORD had prayed, opting to hear ex-parte the government side before giving further orders.
Led by Senior Counsel James Orengo and former Attorney General Amos Wako, and accompanied by CORD Principals Raila Odinga, Kalonzo Musyoka and Moses Wetangula, the opposition coalition has opposed several provisions of the new law citing numerous unconstitutional issues with it.
While making the presentation, Senior Counsel James Orengo told the judge the new law fundamentally changes procedures in criminal law procedures and extremely abrogates fair administration of justice.
Orengo was accompanied by a team of lawyers including Judy Sijeny, Antony Oluoch, Paul Mwangi, Daniel Maanzo and Mombasa Senator Hassan Omar Sarai. Also present in court were ODM politicians Rosemary Nyamunga, Junet Mohamed, Reuben Ndolo, Eliud Owalo, Gladys Wanga, Florence Mutua, and Elizabeth Ongoro.
The government will respond tomorrow morning.
