No nonsense ICC judges have thrown what can only be described as a major spanner in the works and a consequential twist in the trial of president Uhuru Muigai Kenyatta.
The judges now want the Kenyan president to appear before them with the express purpose of setting the record straight on damning allegations that his administration is keen on frustrating justice in his case.
Fatou Bensouda, the stone-faced Gambian prosecutor, has lamented, not once, not twice, about the failure of the Kenyan government to cooperate fully with the court as required of states party to the Rome Statute that established the court .This non-cooperation has forced the prosecutor to suspend indefinitely Kenyatta’s case.
Mr.Kenyatta now faces the real possibility of making dubious history as the first serving head of state to appear before the Hague-based court.
Last year, the President’s loyalists vowed to stage a one-million man march to block the president from honoring any summon where he is required to appear in person.
As we speak,Mr.Kenyatta has offered no hint that he intends not to honor the summon, which, for all practical reasons,he must honor to avoid the unedifying designation of a fugitive fleeing from international justice.
Bensouda’s damning allegations if proven true could deepen the presidents legal troubles which he is fighting to free himself from.
