The absence of Chief Justice Willy Mutunga today led to the adjournment of the hearing of a case in which Nairobi Governor Dr. Evans Kidero is challenging the nullification of his election by the Appeals court. In a majority ruling last month, Appellate court judges G B M Kariuki and Patrick Kiage nullified Kideroâ€™s election saying he was not validly elected.
However, Justice Mohammed Warsame, sitting on the same bench, dissented.
Kideroâ€™s lawyers asked the court for an adjournment citing the absence of Dr Willy Mutunga, the chief justice. The lawyers said they prefer a hearing by the full bench.
The judges obliged and directed all parties to the case to appear on Tuesday, June 10 for the mention of the case where the hearing dates for the case will also be set.
The judges said that until the case comes up for mention the earlier order issued reinstating Kidero as the governor for Nairobi will remain.
