Former President Mwai Kibaki today appeared at the Nyeri High Court over a suit in which he and five others are claiming a prime building in Nyeri town from a company they formed but which wrangles among its directors, without the knowledge of the former head of state, led to the original owners being ejected.
On September 23, the former president and five others moved to court to compel Muthingira wholesalers to allow it collect the rent from the building.
Through Lawyer Gibson Kamau Kuria, the former president told the court how â€˜strangersâ€™ took over the building and were collecting rent without accounting to the true owners â€“ himself and Mr Kimwatu Kanyungu, Mr Kiiru Gachuiga, Mr Gadson Gitonga, Mr Kibera Gatu and the former presidentâ€™s brother Mr Samwel Githinji Kibaki.
The former president who claimed he had been kept in the dark over the dispute said it was a â€˜disgraceâ€™ that the case was brought to the court.
â€œI did not know about the resolution to go to file a suit before the matter was brought to court otherwise I would have intervened as we have been friends for a very long time. Publicly it is a disgrace,â€ he said. Judge Ombwayo then suggested to the former president to have the matter settled out of court.
â€œCan you still arbitrate between the parties? A court order will divide the two groups further while you can still be friends if you try a resolution out of court,â€ suggested the judge. Interestingly, the President was not aware who among the original members still own the premise and whether others had sold their shares.
â€œI am a shareholder of many other companies in this country and I leave them to be run by other members who I trust. I would not know about the daily activities as I was very busy with other matters,â€ he said.
The former president and five others sued by messrs James Kanyi, Peter Nderitu, Paul Wamahiu and Sammy Maina whom he claimed have trespassed on the property since 2008 when they allegedly removed Mr Kanyungu from the chairmanship.
