While declining to issue temporary injunctions to stop her arbitrary sacking, a high court judge dismissed former police boss Grace Kaindi as using the court for ‘social experiments’.
The former Deputy Inspector of Police argued President Uhuru Kenyattaâ€™s decision was unconstitutional and â€œamounts to a roadside declaration with no regards to the laid down laws and proceduresâ€. However, the justice Monica Mbaru of Employment and Labour Relations court failed to agree with Kaindi’s lawyer Joseph Ogutu and ordered him to serve the Attorney General and National Police Service Commission to file their response to the application seeking to have Kaindi reinstated within three days.
â€œThe applicant has in no doubt held an important security docket. However, I have no doubt too in my mind security issues are not equivalent to social experiments. A decision has been implemented and it is impossible to undo the same at this stage,â€ he said.
