High Court Judge Isaac Lenaola yesterday gave a historic ruling declaring hefty presidential retirement perks unconstitutional, null and void.
The perks, including sh 25 million lump sum ‘golden handshake’,Â a pension of Sh560,000 a month, entertainment allowance of Sh280,000 and Sh300,000 a month housing allowance for his urban and rural homes.
In addition, Kibaki, and former President Daniel Moi, were provided with two new cars every three years, two personal assistants, four secretaries, four messengers, four drivers and bodyguards.
â€œThe law is invalidated and declared null, void and unconstitutional,â€ ruled Justice Lenaola.
The two presidents now join former vice presidents and Prime Minister Raila Odinga whom President Uhuru recently declined to sign a new bill into law which would have given him certain benefits far less than what Kibaki accented for himself and President Moi.
It will take a bi-partisan legislature to come up with a new bill.
