Jubilee candidate for Bungoma polls Musikari Kombo today suffered a new election shuddering defeat when Justice Francis Gikonyo ordered his lawyer Alfred Ndambiri to record a statement with the CID for circulating a fake decree that CORD candidate Hon Moses Wetangula has been barred from contesting the elections.
Kombo who is widely expected to lose the Bungoma elections (there is no way he is winning that election in western region) has battled Senator Wetangula at every turn, using the courts to make scandalous claims that Justice Gikonyo found Hon Wetangula culpable of an electoral offence.
On his own motion, Justice Francis Gikonyo clarified he never gave any orders barring Mr. Wetangula from contesting for any elective seat either now or in future.
He added that the omission of the orders in the ruling was deliberate because he is aware of the constitutional requirements regarding the rights of Wetangula.
In his ruling today, Mr. Gikonyo ordered the Deputy Registrar Mr. Atiang Mitula to serve the orders to IEBC & all interested parties.
Former nominated MP Musikari Kombo had through his lawyer Alfred Ndambiri moved to court to have the orders issued amended to reflect an order barring Mr. Wetangula.
As we said earlier, Kombo (read Jubilee Alliance) has lost that election.
