The last ICC prosecution witness failed to appear in court as he wants his whole family moved from Kenya to Europe.
Witness 727 was scheduled to testify but failed to turn up even as the judges had issued orders directing him to either appear or give his testimony via video link.
The witness who has been holed up in the Netherlands got temporary reprieve when Holland police said they would not force him to go to the Hague.
“Having been relocated for the purpose of testifying for the Office of the Prosecutor, this witness has, at various times, either refused to testify at all or placed conditions on his testimony.Â Witness 727 is summoned to testify on March 23” the judges ruled in February.
The prosecution has said that the witness is critical as he has insider information on how Ruto and Sang allegedly planned the violence against PNU (read kikuyus) supporters after the December 2007 elections.
