A number of suppliers and junior NYS officials recently named in the multi-million shilling scam at the ministry of Devolution are now accusing the head of Banking Fraud Unit overseeing the investigations of deliberately covering up CS Anne Waiguru’s trails in the scam so that she escapes being held to account.
News reports in a section of the mainstream press indicate that as high as sh. 45 billion may have been lost in the State Department of Devolution and more specifically at the NYS under CS Anne Waiguru. However, the investigators are narrowing down to sh791 million and less than 10 suppliers.
According to sources digging in one of the biggest Jubilee Alliance scandals, the NYS scam, almost all the companies which have been named had been doing businesses with NYS even before the Jubilee regime came to power. Because of the current scam, these older suppliers are being outed to cover up for the real culprits, they claim.
A number of letters seen by Kenya Today and directed to  Mr. Mugwanja, the lead CID investigator, they accuse him of bungling the investigations by using them as decoys. They are emphatic Mr. Mugwanja is acting on behalf of CS Waiguru, whose companies, some registered under the names of her relatives and PAs, are not being investigated.
“You are using our client and third parties as a smokescreen and a diversionary tactic in order to assist the real culprits get away with whatever rip off happened at NYS. As you deliberately bungle your investigations, you are assisting real culprits escape prosecution while at the same time quite shamelessly widen the net of your investigations to swallow in innocent third parties” reads one of the letters.Â
“By summoning and actually freezing accounts of even innocent parties that received monies from our client, you are creating the false impression that all our client’s monies originated from Nys.  What a joke!”
Another letter by city lawyer Ahmednasir Abdulahi to the same investigator dismisses the ongoing investigations as sham.
We have also gathered that Mr. Mugwanja had acted for Ms Waiguru during the clean-up of the government payroll last year, thus the two are well known to each other. Even more shocking Mugwanja is earmarked to succeed outgoing DCI Director Ndegwa Muhoro who is said no longer enjoys the trust of the system.
According to word within government, the embattled CS personally promised Mugwanja her heavy backing to ascend to the helm of the Directorate of Criminal Investigations, something every sleuth salivates for. Â Waiguru has declined to resign from her position and continues to receive briefs on the NYS scam, despite being a potential suspect.
Even DPP Keriako Tobiko directed her to write a statement over the scam, an order which would ordinarily be effected by the DCI but which remains unheeded, yet a small fly like Lord Mayor George Aladwa was last weekend picked by 27 flying squad officers, guns cocked.
