In declaring CORD protest constitutional, Judge Onguto also decried the use of the courts to curtail political rights stating that the high court cannot draw lines when and where to picket.

Fundamentally, Judge Onguto has said demonstrations cannot happen in private spaces hence must be held in public spaces like roads.

Big blow to warmongers.

The dispossessed and powerless must never lose the right to assemble and protest, a right which is inalienable.

High court judge Joseph Onguto declined to issue orders stopping the ongoing demonstrations on grounds that the petitioners have not shown any evidence to court to warrant any orders.

Police were ordered to provide security and ensure public safety.

Onguto further in his ruling noted that the removal of IEBC commissioners from office must be done within the law.

In the case five jubilee mps led by Hon Ferdinand Waititu moved to court seeking orders to stop CORD leaders from demonstrating against IEBC. They argue that the demonstrations are illegal.
